CA Labor Code §510 · daily + weekly · 2026California Overtime Calculator
California pays overtime by the day, not just the week. Enter your hours and this applies the real rules — 1.5× after 8/day, 2× after 12/day, 1.5× over 40/week, and the 7th-day rule — to show regular, overtime, double-time and pay.
California's overtime rules
California is one of the few states with daily overtime. Under California Labor Code §510, a non-exempt employee earns overtime like this:
| When | Rate |
|---|---|
| Over 8 hours in a workday (up to 12) | 1.5× |
| Over 12 hours in a workday | 2× (double time) |
| Over 40 hours in a workweek | 1.5× |
| First 8 hours on the 7th consecutive day | 1.5× |
| Over 8 hours on the 7th consecutive day | 2× (double time) |
The weekly 40-hour overtime does not double-count hours already paid as daily overtime — this calculator handles that for you so you aren't overpaid or shortchanged.
Meal and rest breaks
Separately, California Labor Code §512 requires a 30-minute meal break before the end of the 5th hour, and paid 10-minute rest breaks. A missed meal or rest break owes one hour of pay at your regular rate ("premium pay"). This calculator covers overtime hours, not break premiums.
Frequently asked questions
What are California's overtime rules?
Per CA Labor Code §510: 1.5× over 8 hrs/day, 2× over 12 hrs/day, 1.5× over 40 hrs/week, and the 7th-consecutive-day rule (1.5× first 8, 2× beyond 8). Weekly OT doesn't double-count daily OT.
When does double time start in California?
After 12 hours in a workday, and after 8 hours on the 7th consecutive day of the workweek.
Does California have daily overtime?
Yes — over 8 hours in a day is overtime even if you work under 40 that week. That's the big difference from the federal rule.
Is the 7th consecutive day always overtime?
If you work all 7 days of the workweek, the first 8 hours that day are 1.5× and anything beyond 8 is 2×.
Is it free?
