Is there a statutory overtime rate in Barbados?

Barbados does not have one universal statutory overtime rate that applies to every worker. The general statute on employment, the Employment Rights Act, 2012 (Cap. 364), sets out contract, dismissal and tribunal rules but does not fix an overtime multiplier. Instead, a guaranteed overtime premium exists only for specific sectors covered by their own legislation. The most important is the Shops Act, 2015-30 (Cap. 356A), which governs "shop assistants" (retail and many clerical/shop-business roles).

For a shop assistant, normal hours are capped at 40 hours per seven-day week (excluding meal breaks), with at least two days off and no more than five working days. Any hours beyond 40 are overtime and must be paid at time and a half (1.5x). Work performed on a day off, a closed day, or a public holiday must be paid at double time (2x) the ordinary rate. A shop assistant is also entitled to a one-hour meal break after about four-and-a-half hours of work.

For employees outside the Shops Act (offices, hospitality, manufacturing, etc.), there is no general statutory overtime multiplier. The Barbados Labour Department has stated publicly that, apart from Shops Act workers, "there is no specific legal requirement" to pay a premium for public-holiday or overtime work; the rate is set by the contract of employment, a collective agreement, or established workplace custom. In practice many employers voluntarily adopt 1.5x for overtime and 2x for holidays, using the Shops Act figures as a guide.

Worked example (Shops Act shop assistant)

Suppose Aisha is a shop assistant in Bridgetown paid the national minimum wage of Bds$10.71 per hour. In one week she works 46 hours, and 4 of those hours fall on a public holiday.

(If those same extra hours were ordinary overtime rather than holiday work, all 6 would be at 1.5x: 6 × Bds$10.71 × 1.5 = Bds$96.39 on top of the Bds$428.40 base.)

Rest days, public holidays and night work

Under the Shops Act a shop assistant is entitled to at least two rest days each week. Work on a rest day, or on a closed day (Good Friday, Easter Sunday, Independence Day and Christmas Day) or any public holiday declared under the Public Holidays Act (Cap. 352), attracts the double-time (2x) rate. There is no separate statutory night-shift premium in Barbados — any night or shift differential is a matter of contract or collective agreement. Overtime for shop assistants is also capped: it is limited to an average of about eight hours per week measured over a four-month period, broadly equating to roughly 150 overtime hours per year.

Exemptions, the labour authority and how to complain

Senior managerial and executive staff are generally treated as outside hourly overtime protection. The Shops Act premiums apply to shop assistants specifically; other categories depend on their own contracts or collective agreements. The relevant authority is the Labour Department within the Ministry of Labour, Social Security and the Third Sector. A Labour Officer can investigate unpaid wages and overtime and attempt conciliation. Unresolved disputes (for example unfair dismissal or unpaid statutory entitlements) can be taken to the Employment Rights Tribunal established under the Employment Rights Act, 2012. To complain, an employee contacts the Labour Department, files particulars of the employer and the hours/pay in dispute, and a Labour Officer follows up before any tribunal referral.

Does the Employment Rights Act set an overtime rate?
No. The Employment Rights Act, 2012 governs contracts, dismissal and the Employment Rights Tribunal but does not fix an overtime multiplier. A guaranteed rate exists only under sector laws such as the Shops Act, 2015-30.
